Gross violation of law

     Governments are institutions in a country which are supposed to protect the people and work for their welfare. If the same government has no respect for the established laws and procedures, then what is even the purpose of making laws?



    The recent incident of a gang rape case against the Hathras in UP shows the government's lack of respect towards its people. It shows the bias in terms of caste, class and position. Now let us question what would have happened if the women had belonged to a upper caste Hindu family and is economically well off? Would the same sequence of events been followed?

    The fact that the family was not informed about the cremation of the body shows the high handedness of the police in selectively dealing with cases. It clearly shows intent to disrupt the justice system. An open transparent post mortem would have exposed the truth. But the truth was not allowed a fair opportunity to express itself. This amounts to gross violation of justice. In fact it is a violation of Article 21 of the constitution, which is a fundamental right. Article 21 guarantees Right to Life and personal liberty. Article 21 also includes dignity of an individual. The dignity of an individual is not restricted to only the living but also the dead! It entails a proper investigation of the cause of the death and providing justice is mandatory if the person's rights were violated, inhumanely murdered or left in a vegetative state. And also the right to proper cremation!

    Humans are different from other species because we have conscience and consciousness. The Dalits were deprived of their conscience and a sense of individuality historically. Especially in Northern India, the caste taboo is very intense. Caste there is just not a system, but an emotion. There is a very deep influence of caste impinged in the individuals especially in rural areas. Children grow around internalising these caste values and over a period of time, they become the part of this discriminating whole. Sometimes they even assign a colour to the lower castes! How can a child who is hypnotised to discriminate against a certain caste be converted into a rational human being?

     In today's democratic world, if caste and class taboos have an influence in the polity and governance, then what is the meaning of our independence? The true meaning of independence can only be realised when all individuals are given equal and fair opportunity to grow in a rules based human oriented society. Where is the conscience of the people who are doing this? Why are they not able to humanise themselves? It is when all these elements are humanised, then we can call our society a truly human society.
